Terms & Conditions

INTRODUCTION AND GOVERNING LAW

These are the Terms & Conditions of

Sale applicable to on-line purchases from Australian IT Spares.
These terms and the laws of NSW,
Australia, apply to all transactions for the purchase of products ("Products") from Australian IT Spares through its website at www.itspares.com.au and any associated web page ("the Site").  These terms represent the complete agreement between Australian IT Spares and the Buyer covering the purchase of Products from this site.  Except for terms implied by applicable legislation, Australian IT Spares does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms.  The Buyer's completion of the order form on this site will constitute an offer to the Buyer to purchase Products (the "Order").  All Orders are subject to acceptance by Australian IT Spares.

PRICES

All prices appearing on this website are in Australian dollars (AUD).

The prices to be paid by the Buyer for all Products will be Australian IT Spares's current selling price on the date of receipt by Australian IT Spares of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as displayed when checking out.

Australian IT Spares will not be responsible for errors in pricing that appear on the Site.  Australian IT Spares will notify a Buyer in the event of a pricing error on the Site before an Order is delivered.  The Buyer will have the opportunity to cancel their Order within a reasonable time.

Australian IT Spares reserves the right to change its prices from time to time without prior notice to the Buyer.  All prices in this website do not include Australian Goods and Services Tax (GST) of 10%, until final checkout page, where GST is added to the order total.

The GST payable by the Buyer will be shown on the invoice which Australian IT Spares will send to the Buyer.  Delivery charges to the nominated address will be advised to the Buyer on the Checkout and Order confirmation pages of the Site.

STOCK AVAILABILITY

By purchasing from our website, the Buyer accepts that Australian IT Spares may not have all items in stock at the time of purchase and it is possible a delay of up to 14 days will be experienced in delivery of the Buyer's order.  Occasionally, Australian IT Spares are unable to source items that are listed on this website, in which case the Buyer will be notified as soon as Australian IT Spares becomes aware of non-availability of the item and the full amount paid by the Buyer for the item will be refunded.  If the expected delivery time is likely to exceed 14 days, Australian IT Spares will contact the Buyer to advise of this.

ORDER ACKNOWLEDGEMENT AND CANCELLATION

All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):

(a) Quantity and description of Products;
(b) The full street address to which the Product is to be delivered;

The Buyer must complete all information requested on the Order form before the Order is processed by Australian IT Spares.

Australian IT Spares will not accept orders:

(a) If the Buyer does not offer to pay by one of the payment methods listed in this website; or
(b) If the Buyer's credit card provider does not confirm the payment.

Australian IT Spares will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order.  If Australian IT Spares does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.

If the Buyer wishes to cancel an Order prior to shipment, the Buyer must contact Australian IT Spares Customer Service immediately on 1300 394 800 and/or e-mail sales@itspares.com.au. Australian IT Spares will endeavour to accommodate the Buyer's request, if the merchandise has not been shipped.

If the Buyer's entire order is cancelled prior to shipment, Australian IT Spares will apply a credit to the Buyer's credit card and may also apply a cancellation fee.

If an Order has already shipped, Australian IT Spares's normal returns and exchanges procedure will apply.

DELIVERY

Shipment will occur as soon as the ordered items are in stock.  A Buyer can arrange collection of Orders from Australian IT Spares either in person or via Australia Post Regular/Express, or alternatively a courier service.

The Buyer acknowledges that Australian IT Spares may, from time to time, be subject to production, delivery or other unforeseen delays and that Australian IT Spares may allocate distribution of Products ordered among its customers at its sole discretion.

If the Buyer's Order has not been delivered within a reasonable time, the Buyer should contact Australian IT Spares at sales@itspares.com.au.

If no one is available at the delivery address to receive the Products, Australian IT Spares’ delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products.  Australian IT Spares reserves the right to make partial delivery of an Order.

PAYMENT

Payment for Products purchased from Australian IT Spares via the Site can be made by Credit Card (PayPal) or Direct Bank Deposit.

Australian IT Spares will verify the credit card information submitted by the Buyer and will advise the Buyer that the Order has been accepted.  The Buyer agrees to submit to Australian IT Spares such information as may be reasonably requested by Australian IT Spares for the authorisation and verification of its credit card purchases.

Australian IT Spares reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider.  In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, Australian IT Spares at its discretion may delay or cancel delivery of Orders placed by the Buyer.

Australian IT Spares may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to Australian IT Spares.  If the Buyer's account is placed in collection, Australian IT Spares will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.

RETURNS

Defective Items and Warranties

All parts are covered only by manufacturer’s or Australian IT Spares warranties.
If an item arrives in not new condition as a result of a manufacturer defect, or a defect occurs during the intended use of the product, please contact us on 1300 394 800 for further information.

Australian IT Spares does not reimburse for labour, incidental, or any other costs related to the installation of products under any circumstance.

Incorrect Supply of Order

If, due to a warehouse or other error on the part of Australian IT Spares, the Buyer receives a Product which does not conform to its Order, the Buyer must contact Australian IT Spares within 7 days of receipt of the Product and complete a Return Request.  On approval of the Return Request and receipt of the incorrect Product back into Australian IT Spares's store, the correct Product will be posted to the Buyer at no extra cost to the Buyer.  Postage for return of the incorrect Product and for supply of the correct Product to the Buyer will be paid by Australian IT Spares. The incorrect Product must be returned in new condition in its original packaging.

Incorrect Part Ordered by the Buyer

If the incorrect Product is ordered by the Buyer, the Buyer must contact Australian IT Spares within 7 days of receipt of the Product and complete a Return Request. On approval of the Return Request and receipt of the incorrect Product back into Australian IT Spares's store, Australian IT Spares will refund the price paid for the Product. Postage for return of the incorrect Product will be paid by the Buyer. The incorrect Product must be returned in new condition in its original packaging. If a replacement Product is required, the Buyer may complete a new Order for the correct Product and the new Order will be treated as a separate and new transaction.

Damaged Shipments

All packages should be completely inspected at the time of delivery.  Damaged packages should be refused. Please then call the freight company or Australia Post (whoever is responsible for the package) and report the damage.  After contacting the carrier, please call Australian IT Spares on 1300 394 800 for further assistance with the damaged shipment, and to make arrangements for a replacement.

FREIGHT METHODS

Australian IT Spares will arrange delivery of all Products to the Customer using its nominated freight carriers.

RETENTION OF TITLE

The Products and any other goods delivered by the Australian IT Spares to the Buyer shall remain the sole and absolute property of Australian IT Spares as legal and equitable owner until such time as all money due to Australian IT Spares has been paid but shall be at the Buyer's risk from the time of delivery.

All information, services, products, and materials contained in this site, including text, graphics, and links, are provided on an "as is" basis with no warranty.  To the maximum extent permitted by law, Australian IT Spares disclaims all representations and warranties, express or implied, with respect to such information, services, products and materials, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer virus, and implied warranties arising from course of dealing or course of performance.  In addition, Australian IT Spares does not represent or warrant that the information accessible via this site is accurate, complete or current.  Price and availability information is subject to change without notice.
